Welcome to iPad Forums, Cooter85!

The iPad is connected to an iCloud account, and there's no possibility to use it, even if you think of jailbreaking it. iCloud activation lock is a security feature of iDevices since iOS 7 was introduced.

Here's what the previous owner should do, to remove the iPad from his iCloud account:
What to do before selling or giving away your iPhone, iPad, or iPod touch - Apple Support

If it's not possible to contact him (email?), the device will remain locked. Sorry!

As a last resort, you could contact the police. The seller did commit a fraud, after all, selling you a useless iPad. If you do contact the police, give them all the info you have on the seller, they may be able to track him down.

Seems strange. Unless he had just stolen it, while it was powered up, what was the point of not clearing the icloud account, etc. He has got his money and you have the device.... Perhaps he just did not know and an honest mistake? Else, as I say, it was very recently stolen in which case the police may know about it. ☹
