I'm not quite sure what you mean by this post.

Cydia is a "store" for those people who have jail broken their iDevices. It comes "free" when the iPad is jail broken, and allows you to browse to find neat stuff to install on your iPad. So, all jail broken iPads have the Cydia app/icon.

Oh, and jail breaking is not illegal, nor is Cydia. And, if you are jail broken, you can still (and easily!) enjoy any/all Apple applications.
