They wont be charging, They looked at the number of people who payed to upgrade the itouchs vs number of people who didn't and saw that most people didn't. Then since those people didn't upgrade all the newer apps had computability requirements of the newer OS and wouldn't work for those users. Not upgrading also puts the devices at a big security risk since no patches would be applied for known security vulnerabilities.
They are going to make the updates free from now on, they put in the terms of agreement that apple only HAS to provide 1 free major update just in case they decide to change their mind in the future.
