The latest news from AP, Apple Inc. has sued Samsung Electronics Co., accused the South Korean company’s Galaxy line of smartphones and tablet computers copied Apple‘s iPad and iPhone.
“Instead of pursuing independent product development, Samsung has chosen to slavishly copy Apple‘s innovative technology, distinctive user interfaces, and elegant and distinctive product and packaging design, in violation of Apple‘s valuable intellectual property rights,†Apple says in the lawsuit filed in U.S. District Court for the Northern District of California.
In the lawsuit, Apple pointed out that Samsung Galaxy phone is properly being viewed as an Apple product simply based on the design.
Apple declared Samsung has violated Apple’s 16 rights.Including 10 charges of patent infringement, 2 of trademark violation and 2o of trade dress violations, plus unjust enrichment and unfair business practices. Apple named Samsung Electronics, Samsung America and Samsung Telecommunications America as defendants.
In the lawsuit, Apple said, “The copying is so pervasive, that the Samsung Galaxy products appear to be actual Apple products — with the same rectangular shape with rounded corners, silver edging, a flat surface face with substantial top and bottom black borders, gently curving edges on the back, and a display of colorful square icons with rounded corners,†While the early smartphones of Samsung haven’t take the same design as Apple. †Early editions of Samsung smartphone icons look different from now, because they are in various shapes, no square icon area with round corners, either.â€
What’s more, Apple accused Samsung engaged in “fraudulent and unlawful business practices†and unfair competition under California law. Apple also charged Samsung with “unjust enrichment†under federal law. “Apple seeks a worldwide accounting and disgorgement of all ill gotten gains and profits resulting from Samsung’s inequitable activities,†the complaint says.
Apple said Samsung continued the alleged violations despite repeated objections, leaving the company no choice but to sue.
Apple’s spokeswoman Hugue declared:â€The openly copy is not right.†While Samsung’s representative Titus said, “Samsung will respond actively to this legal action taken against us through appropriate legal measures to protect our intellectual property,â€
Samsung respond via email, says the company’s products are the result of its own research and development. He says Samsung plans to defend itself against Apple’s lawsuit.
Jackson, analyst of CCS Insight referred, in this period, Samsung is the only one who can be counted as Apple’s real tablet PC market.â€
In 2007, Apple released iphone, and since then upgraded the device several times. Last year, Apple released the iPad, and began selling the iPad 2 in March this year. The company had sold over 108 million iPhones and 19 million iPads, as well as more than 60 million of the iPod Touch.
Samsung began selling the Galaxy smartphones and Galaxy Tab tablet computer in the U.S. last year, all of which run on Google‘s Android OS. Samsung is the world’s largest manufacturer of flat screen televisions, liquid crystal displays and computer memory chips. Its memory chips are used in the iPad.
Recently, some smartphone manufacturers and software companies sued on their smartphone patents in succession, Apple is one of them. For example, Nokia sued Apple’s infringement, and Apple charged HTC.

5.This is clearly rubbish. Apple has a trademark and if Samsung has a similar product then does not mean to say it has infringed trademark. The trademark will be apples look however as a galaxy user I wouldnt use apple even if they gave it to me for free. Just because something looks similar does not mean to say they have infringed the trademark it hs to be a distinct copy whihc leads to confusion. Samsung has not called the product apples or appalia etc. It disticnly shows that apple is worried about its market share and competition from samsung. every seed company should be suing the other as one wheat variety seed looks similar to other.

Ok well that just describes every mobile phone released in the last ten years. Maybe Apple is just coming to realise that the i-phone’s day is done and wants to cause trouble for the new leader in mobile tech.
