When you get your email from Apple store with this charge, you will have an option to report a problem with the transaction. By using this reply to email, Apple will have a 'paper trail' to investigate. I have had a similar problem on an app that I thought was usable on an iPad but as it turned out after getting it, the app was for an iPad with a camera. After explaining my problem, Apple refunded the app.

There may a fee in the fine print. You might want to check for that first so you have a better way to plead your case.

So is it possible that the fine print is more expensive than the "miss charged" money that might be refunded?
