but you should be warned about that... loads of people i know got the text, not me
I've heard of the texts about MyWi tethering from AT&T, but here are a few facts:

    1. Unless you are tethering ALOT, you won't get that text (I never have).
    2. Even if you do get that text, they cannot prove that you are tethering. They are speculating just on the amount of data traffic alone - that's it. If you call them and tell them you aren't tethering, they won't charge you. You just tell them that you are a heavy Pandora user, etc....

I just use it to tether my iPad. I have not gotten a text from them. I agree with the others, if you use it to tether your laptop and use Internet Explorer or Firefox they stand a better chance of picking you up.

I actually heard of a guy who tethered his PS3 through MyWi (stupid move), of course he got nailed.

AT&T can precisely determine whether you are tethering, or not. Every mobile device sends it's IMEI along, when it connects to the Internet. When you signed up with AT&T, you gave them your IMEI, so when you tether and go online with another device, a second unknown IMEI will show up as using your account and the provider knows that you are tethering.

    But I may be wrong.

I stand by my comments, which was if the OP jailbroke primarily because he thought he would get a good flash experience, he will be sorely disappointed. If you disagree fine, but don't insinuate I'm spreading misinformation by quoting a dead project such as frash, AFAIK the only JB flash related enabler which never got past version 0.0.2 beta testing by Comex before it was abandoned last October. Yes there a plenty of proxy browser flash enablers (mostly video), in the app store, which again supports my statements, because there is no need to jailbreak to use them.

If you want us to take you seriously on this crusade against mis-information of this site, which you seem to have adopted as your personal mission, start offering solutions rather then criticisms and be respectful in accordance with the forum rules. We all make mistakes from time to time, and it's right that people pick up and correct those mistakes (I've made some clangers myself), but I see no evidence of widespread misinformation which you keep banging on about in your posts...
What i do see is a strong community of like minded iPad enthusiasts which I am very proud to be a part of, "mis-information" and all...

I don't think I have heard iswifter works great ~ but that it works, sluggish and all.

You have found nothing but mis-information here? But yet you are still here. Why is that?

    Back to the tether thing.

If you tether with your device through your iPhone. It would send the IMEI of your iPhone as that is what you are actually using to connect to the net with. AT&T can see that your iPhone is connected (based on the IMEI it sends) and using data. If you use a lot of data they may flag you and take a look at your data stream of what you have been doing. If your data stream shows the use of Firefox or something other than an iOs app they can tell if you are tethering. As your phone is just a router at this point.

A lot of this is speculative as from what I have read nobody is certain on how they know (or even if they actually know and can prove it). Many people believe it is a bluff on their part. Who knows.....

Unless he thinks "misinformation" is an opinion that is different than his. Lol.

However, some forums do not base their information on facts and go on opinion alone (but that is actually what a forum is). A forums information is based on other people's opinions and experiences. In my opinion it is the best form of information and feedback. If you want to check facts, that is what Google is for.

I have seen no misleading misinformation here.

    Stepping off my soapbox now.......

I tend to agree that AT&T are likely just analysing traffic volume and patterns on your device and nothing more. I doubt they are going to a level of identifying a browser client on HTTP traffic, but they are analysing none the less.
I don't see any evidence that mac address or IMEI play any part in it. Ive seen places require you to register a device mac address for network access and tethering works fine if you register the phone and then connect multiple devices through it. My speculation is it's just your luck whether your usage patterns make you get flagged or not...
